These Terms of Use ("Terms") govern your access to and use of beplenish.com (the "Site") and any products you purchase from us (collectively, the "Services"), operated by BePlenish, Inc. ("BePlenish", "we", "us", or "our"). For purposes of these Terms, "you" and "your" means you as the user of the Services, whether you are a customer, website visitor, or another individual accessing the Services.
Please read these Terms carefully. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use or access any of the Services.
Changes to These Terms
We may update these Terms from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Terms on the Site and update the "Last updated" date. Your continued use of the Services after the revised Terms are posted constitutes your acceptance of them.
Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to purchase from the Services. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and complete.
Products and Product Information
BePlenish sells dietary supplements. We make reasonable efforts to describe our products accurately, but we do not warrant that product descriptions, images, pricing, or other content on the Site is complete, current, or error-free.
Product colors may appear differently on different displays. Packaging and formulations may change over time. Always read the label on the product you receive before use.
Pricing and Orders
All prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes and shipping charges are calculated at checkout.
In the event a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel any order for that product, whether or not the order has been confirmed. If your order is cancelled for this reason, we will issue a full refund.
We reserve the right to limit order quantities and to refuse or cancel any order at our discretion.
Your order constitutes an offer to purchase. Acceptance occurs when we send you a shipping confirmation.
Subscriptions and Automatic Renewal
If you enroll in a subscription:
- Recurring charges: You authorize us to charge your designated payment method automatically on each billing date until you cancel. Your subscription price, billing frequency, and delivery schedule are disclosed to you before you complete enrollment.
- Cancellation: You may cancel at any time through your account or by contacting us at contact@beplenish.com. To avoid being charged for an upcoming cycle, you must cancel before that billing date. Once an order has been processed, our standard return policy applies.
- Price changes: We will notify you by email before any subscription price increase takes effect.
- Failed payments: If a payment method is declined, we may retry the charge and may suspend or cancel the subscription.
Shipping and Delivery
We ship within the United States. Delivery timeframes displayed on the Site are estimates and are not guaranteed. Carrier delays are outside our control.
Title and risk of loss pass to you upon delivery of the products to the carrier. If your order arrives damaged or does not arrive, contact us at contact@beplenish.com and we will work with you to resolve it.
Returns and Refunds
Unopened products may be returned within 30 days of delivery. Complete details, including how to initiate a return, are set out in our Refund Policy.
Health Disclaimer
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease.
BePlenish products are dietary supplements and are not medications. No content on the Site, in our emails, or in our advertising constitutes medical advice, and none of it is a substitute for consultation with a qualified healthcare professional.
Consult your physician before using our products if you are pregnant or nursing, have any medical condition — including any condition affecting iron levels, blood pressure, or kidney function — or take any medication. Review the full ingredient list before use if you have any allergies.
BeVital contains iron. Keep out of reach of children. Accidental overdose of iron-containing products is a leading cause of fatal poisoning in children under 6. In case of accidental overdose, call a doctor or poison control center immediately.
Discontinue use and consult a healthcare professional if you experience any adverse reaction.
Individual results vary. Customer reviews reflect the individual experiences of those customers and are not a guarantee of any particular result.
Promotions and Discount Codes
Unless otherwise stated, discount codes are limited to one use per customer, may not be combined with other offers, have no cash value, and may expire or be withdrawn at any time. We reserve the right to cancel orders in which a discount code was used contrary to its intended terms.
User Content
By submitting a review, photograph, comment, or other content to the Services ("User Content"), you retain ownership of that content and grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, modify, and distribute it in connection with our business and marketing, without compensation to you.
You represent that your User Content is your own, is truthful, and does not violate any law or the rights of any third party. You agree not to submit content that is false, defamatory, obscene, threatening, or that contains the personal information of another individual. We reserve the right to remove any User Content at our discretion.
Intellectual Property
The Services and all content on them — including the BePlenish and BeVital names and logos, text, photography, graphics, and design — are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may access and browse the Site and share links to it for personal, non-commercial purposes. You may not copy, reproduce, distribute, resell, or create derivative works from our content without our prior written permission.
Prohibited Uses
You agree not to use the Services to violate any applicable law, impersonate any person or entity, scrape or harvest data, introduce viruses or malicious code, interfere with the operation or security of the Services, or attempt to gain unauthorized access to any portion of the Services. We may suspend or terminate your access for any violation.
Third-Party Links
The Services may contain links to third-party websites. We do not control and are not responsible for the content, products, or privacy practices of those sites. Accessing them is at your own risk.
Disclaimer of Warranties
The Services and all products are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be uninterrupted, secure, or error-free.
Limitation of Liability
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Services or any product shall not exceed the amount you paid for the order giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, or lost data, whether based in contract, tort, or any other legal theory.
Some jurisdictions do not permit the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits any right you have that cannot be limited under applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless BePlenish, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Services or your breach of these Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.
Severability
If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
